Workplace Safety Watch – July 2019

Construction

On 23 July, Rahul Kumar (21), Kirpal Kumar (29) and Surendra Kumar (48) were killed as safety locks of a temporary lift were accidently released in an under-construction MLA (Member of Legislative Assembly) quarters in Amravati, Andhra Pradesh. The workers, employed on contract by Nagarjuna Construction Company (NCC), were migrants from Bihar. The police have registered a case under Section 174 of the CrPC.

On 21 July, Dev Raj (52) was killed as the wall of an under-construction building where he was employed collapsed owing to heavy rains in Nagarota Bhawan area in Kangra, Himachal Pradesh. The police have registered a case under Section174 of IPC.

On July 3, 2 workers Mohammad Hafeez (45) and Harsha Dewasi (20), died as a 10 feet high wall of an under-construction temple collapsed on them. Police have registered a case under Section 174 (unnatural death) of the CrPC against the temple trust.

On 3 July, Radhelal Patel (25), Mamata (22), Jitulal Patel (50), Pradeshnin (45), Jitu Rawate (23) and Pralhad (21) died as a 50 feet wall of the under-construction Sinhgad Technical Institute in Maharashtra caved in on them. Police have registered a case against the contractor and several others from the institute’s managing board invoking Sections 304A (causing death by negligence), 337, 338 (causing grievous hurt by act endangering life or personal safety of others) and 34 (common intention) of IPC.

Manufacturing

On 27 July, Shambhu (40) and Ram Paswan (38) were killed and 8 others; Mintu, Prabhu, Pradeep Kumar, Rajesh Kumar, Jeetu, Harinder Kumar, Sanjay and Chandan sustained severe burn injuries due to a boiler explosion at the DC Steels factory in Ludhiana. The explosion occurred around midnight when 25 workers were on night shift duty.

On 26 July, Mallesh (27), a contract worker at Arjas Steel died after refractory bricks fell on him leading to his falling on the sharp fork of the machine which pierced through his neck.

On 26 July, contract worker Ajay Keshav Motghare (22) was crushed to death under a machine unloading coal from a wagon at the NTPC power plant in Mouda, Nagpur. Ajay’s services were contracted out by NTPC to Sai Urja Indo Ventures. A case has been registered under Section 174 of CrPC.

On 17 July, 2 workers Kannan and Shenbagraj died after a fire engulfed a medicine manufacturing factory in Ilanji, Tirunelveli. The police have registered a case against the owners of the unit under Sections 285 (negligent conduct with respect to fire or combustible matter), 287 (negligent conduct with respect to machinery) and 337 (causing hurt by act endangering life or personal safety of others) of IPC.

On 13 July, Daya Gaud (40), a migrant worker hailing from Odisha employed at a handloom factory in Surat died of electrocution. Over 500 workers protested the death of their colleague caused by negligence of the employer. Police used tear gas and arrested 21 workers on charges of rioting and damaging property, while no case has been filed against the employers for causing the death of Daya Gaud.

On 13 July, 3 workers Sangeeta Devi (46), Manju Devi (50) and Shoaib (19) died when a factory in Jhilmil Industrial Area in Delhi caught fire around 9 am, just after the work had started in the factory. The factory according to the fire deparment did not have a valid no-objection certificate.

On 11 July, a series of explosions at a chemical factory in Derabassi, Punjab killed 2 workers Sukhwinder Singh (22) and Ravi Kumar (20) and left over 12 workers critically injured.

Other

On 18 July, Manikandan (30) a contract worker employed in maintenance work at the Chennai Airport died after he fell from an elevated fork lift while cleaning the canopy installed over the parking lot. Manikandan was not provided any safety equipment.

On 15 July, 2 workers Ranjit Mandal (30) and Shanichar Yadav (35) died of asphyxiation after entering a well to clean it in Bihar’s Munger district.

On 10 July, Sukhwinder Singh Sukha a worker employed to repair the defunct tube well died when he entered the well to perform the task.
